The Services
The Tier websites, related mobile applications and services (collectively, the "Services") are provided by Tier Innovations, Inc. BY ACCESSING OR USING THE SERVICES, YOU AGREE TO THESE TERMS.
Registration and Accounts
The Services are intended for persons who are at least 13 years old. You must provide accurate information and maintain one personal account. You are responsible for maintaining the confidentiality of your password.
Payments and Fees
Subscription fees are payable in advance and will auto-renew until cancelled. You may cancel at any time, and cancellation takes effect at the end of your current billing cycle.
Ownership of Content
You own the content you post, but grant us a non-exclusive, worldwide license to use it. Content will be non-confidential unless marked as private in your settings.
Content Restrictions
You must comply with Tier's Acceptable Use Policy. We may remove content that violates our Terms. You are responsible for all content you post.
Professional Athletes
Verified professional athletes may receive a free subscription. We reserve the right to remove verified status at any time.
Groups
Tier creates and administers certain clubs. Club administrators must ensure their clubs abide by our Terms and Community Standards.
Artificial Intelligence Features
Tier offers optional AI-powered features, including coaching feedback on your goals, weekly training insights, generated workout routines, and a coach chat (the "AI Features"). The following terms apply to your use of them.
Automated output. Responses from the AI Features are generated automatically by a machine learning model, without human review. They may be inaccurate, incomplete, or unsuitable for you.
Not professional advice. The AI Features do not provide medical, health, nutritional, or professional coaching advice, and using them creates no coach-client or practitioner-patient relationship. Consult a qualified physician or coach before acting on any AI-generated suggestion, particularly before changing your training load. You are solely responsible for decisions you make based on AI output, and your athletic activities carry the inherent risks described under Disclaimer of Warranties.
Your input. You are responsible for what you submit to the AI Features. Do not submit content that is unlawful, that infringes another person's rights, or that contains sensitive personal information about anyone other than yourself.
Usage limits. Access to the AI Features is subject to usage limits, which we may set, change, or remove at any time. We may suspend or discontinue the AI Features, in whole or in part, at our discretion.
Acceptable use. You may not use the AI Features to develop, train, or improve any machine learning model; systematically extract, scrape, or bulk-collect AI output; resell or redistribute AI output as a standalone service; attempt to circumvent usage limits or safety measures; or generate unlawful, harmful, or misleading content.
Third-party processing. The AI Features are processed using third-party AI providers, and your use of them is also subject to those providers' restrictions. See our Privacy Policy for what information is sent.
No warranty. The AI Features are provided "as is" and without warranty of any kind. The Disclaimer of Warranties, Indemnity, and other limitations in these Terms apply to them in full.
Third Parties
We are not responsible for third-party products, services, or content available through the Services.
Proprietary Rights
Tier owns all rights to the Services, including trademarks and software. You may not modify or create derivative works.
Claims of Infringement
We respond to DMCA notices. If you believe content infringes your copyright, contact our Copyright Agent at tierinnovationsinc@gmail.com.
Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY. TIER DOES NOT PROVIDE MEDICAL ADVICE. YOUR ATHLETIC ACTIVITIES CARRY INHERENT RISKS.
Indemnity
You agree to indemnify Tier from claims arising from your use of the Services or your content.
Class-Action Waiver
Disputes will be resolved through individual arbitration, not class action.
Choice of Law
These Terms are governed by California law. Actions must be brought in San Francisco, California.
Termination
Tier may suspend or terminate your account for violations of these Terms, at our discretion.
Modifications
Tier may update these Terms at any time. Continued use after notification constitutes acceptance.
